Arson fires like these can be very hard to prove. I’ve been involved in a couple of big arson investigations and even with top notch cause and origin investigators helping, they’re a real bitch.

I think the prosecutor’s office did the right thing by admitting they can’t prove the case. I’m sure they were under a lot of political pressure to hang those kids out to dry.

I’m not so certain the US Attorney’s office will take up the case. They don’t like prosecuting juveniles as a general rule leaving it up to local authorities to handle.

Being just a stone throw away from the Smokies, I find this very disturbing news.
I was just asking myself “why would they do this?” before I read your post Zulu 3-6.

There is more to it than just proof. They are also dealing with jurisdictional issues, local and feds. It’s a very complicated case due to the widespread nature of the wildfire, the venue of the origin, the venue of the deaths, the vagaries of weather, etc.

The way I read the article, the locals and the feds are not arguing about jurisdiction issues, it just exists and they are maturely recognizing that legal fact.
